1. Introduction
These Terms and Conditions govern the use of the online merch store operated by the Open Home Foundation (hereinafter referred to as 'we', 'our', or 'us'). By placing an order through our website at https://store.openhomefoundation.org, you agree to be bound by these Terms and Conditions. Please read them carefully before making any purchase.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to make purchases from our online merch store.
3. Products and Orders

All articles displayed on our website are subject to availability. We reserve the right to refuse or cancel any order at our discretion. The product information on the website (photographs, dimensions, descriptions and other features) are only to be understood as approximate representations and do not represent any warranty or guarantee of specific features of a product, unless they are expressly designated in writing as binding.
4. Pricing and Payment
All prices are listed in the applicable currency and include taxes where required by law. Product prices may be amended without notice. Delivery costs are payable in addition to the stated product prices. Payment must be made using the methods specified on our website. We reserve the right to correct any pricing errors before or after an order is placed.
5. Delivery
We deliver to domestic and international addresses. Delivery times as shown on the checkout page are estimates and may vary based on location and customs procedures. Delivery costs as well as further charges of the Open Home Foundation or third parties or authorities for customs clearance, import into the destination country or similar are to be paid by the customer. Risk of loss passes to you as soon as the consignment has been handed over to the company carrying out the transport. If goods delivered have obviously been damaged during transport, you should contact the delivery company.
6. Withdrawal
Right of withdrawal:
You have the right to withdraw from any contract of purchase concluded on the online merch store of Open Home Foundation within fourteen (14) days without giving any reason. The withdrawal period begins on the day on which you or a third party designated by you, who is not the delivery company, took possession of the purchased items.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement (e.g., a letter sent by post or an email). You can contact us at:

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.
Effects of withdrawal:
We will refund all payments received from you, including standard delivery costs, without undue delay and at the latest within fourteen days from the day we receive your notice of your withdrawal from the contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged for this refund.
We may refuse to refund until we have received back the purchased items or you have supplied evidence of having sent them back. You must send back the purchased items without undue delay and in any event no later than fourteen days from the day you notify us of your withdrawal from the contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You should follow the procedure for returns described in clause 7 below.
You bear the direct cost of returning the goods. You are liable for any loss in value of the goods only if it results from handling beyond what is necessary to test their condition, properties and functionality.
The right of withdrawal does not apply to contracts for, among other things, the delivery of non-prefabricated goods that are manufactured according to customer specifications, perishable goods, sealed goods for reasons of health protection/hygiene if the seal has been removed after delivery, as well as in other cases regulated by law. In the case of services, the right of withdrawal expires prematurely if we have provided the service in full with your prior express consent and you have simultaneously confirmed your knowledge that you lose your right of withdrawal upon complete fulfilment of the contract; for digital content not provided on a physical data carrier, it expires if we have begun execution with your express consent before the expiry of the withdrawal period and you have confirmed your knowledge that you thereby lose your right of withdrawal.

7. Returns and Refunds
You may return items within 30 days of receipt, provided they are in original condition and packaging. Returns are handled by our logistics and warehousing partner OGOship Ltd, Palkkatilanportti 1, 00240 Helsinki, Finland. In order to return a product please contact us at merchsupport@openhomefoundation.org, from where we will provide you with a return label.
Where goods are returned following withdrawal from the contract (see clause 6 above), the provisions on effects of withdrawal will apply. In all other cases of returns, the following applies: The purchase price of returned items, including standard delivery costs, will be refunded to you. You are responsible for the cost and risk of safe transport of the returned goods. Refunds will be processed to the original payment method. Certain items may be excluded from returns as indicated on the product page.
8. Contact Form
You are responsible for ensuring that any information or input you provide to the Open Home Foundation, whether through the contact form on the website or otherwise, is, to the best of your knowledge, accurate and relevant. Unless otherwise agreed, the Open Home Foundation may rely on such information without independent verification. While we will do our best to respond to queries and comments sent through the contact for on the website, communications via the contact form do not constitute formal notice to the Open Home Foundation.
9. Intellectual Property
Unless otherwise stated, all content on our website at https://store.openhomefoundation.org, including images, logos, and text, is the property of the Open Home Foundation and protected by intellectual property laws. You may not use, reproduce, or distribute any content without prior written permission of the Open Home Foundation.
10. Privacy
Your personal data will be processed in accordance with our Privacy Policy, which is available here[b].
11. Limitation of Liability
To the maximum extent permitted by law, we exclude all liability for any indirect or consequential damages arising from your use of our online shop. Our total liability shall not exceed the amount paid for the purchased items, excluding delivery costs and charges.
If you are a consumer (i.e. purchasing goods for purposes outside your trade, business or profession), nothing in these Terms and Conditions limits your non-waivable statutory rights under the law of your country of delivery.
12. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland, excluding its conflict of law provisions and the UNCITRAL convention on the international sale of goods. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Canton of Zug, Switzerland.
13. Changes to Terms
We reserve the right to amend these Terms and Conditions at any time. Changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.
If any provision of these Terms and Conditions is found to be invalid, this shall not affect the validity of the remaining provisions or the Terms and Conditions as a whole.
